Prostitution in Georgia

Prostitution may be the "world's oldest profession," and there are those who would contend that is a "victimless" crime, but in the state of Georgia and around the rest of the country it is a crime nonetheless. A charge of prostitution is considered to be a misdemeanor, and it is punishable by a fine of up to $1,000 as well as incarceration of up to twelve months. Simply defined, the crime of prostitution has been committed when someone solicits money in return for sexual acts.

In addition to the charge of prostitution in itself, there are also laws against pimping. Charges of pimping can be lodged against an individual who either takes money in behalf of a prostitute, or in some way facilitates an act of prostitution. This includes making the arrangements for a meeting, or in some cases, simply directing someone to a location where they may be able to enlist the services of a prostitute.

A third law that is in place to respond to prostitution is the statute that prohibits keeping a place of prostitution, sometimes referred to as a brothel. This crime, like the charge of pimping, is considered to be a misdemeanor of a high and aggravated nature. Both charges carry with them a fine of up to $5,000 in addition to the possibility of up to a year in jail, at the discretion of the presiding judge.

When an individual is charged with prostitution, the wisest course of action is to retain the services of a competent and experienced Georgia criminal attorney before making any statements or admissions. There are clearly many vagaries surrounding this specific crime concerning the exchange of money for sexual favors, and there can be entrapment issues or potential misunderstandings at play in some instances.

Being accused of the crime of prostitution does not mean that you are necessarily guilty of this charge, and your attorney can evaluate the evidence against you and recommend the most amenable course of action going forward. Never assume that you have no recourse other than acceptance of guilt before you have spoken with an attorney who is experienced with prostitution cases in Georgia.
